By accessing this broker portal and participating in the Apex Diamond Wholesale Program, you agree to the following Terms & Conditions.

Program Access

Access to this portal is provided through an active paid membership.

Your membership grants you:

  • Access to wholesale pricing

  • Product catalog and ordering capabilities

  • Training materials and resources

Apex Diamond Company reserves the right to modify, suspend, or terminate access at any time.

Membership & Billing

Membership is billed on a recurring basis.

By enrolling, you agree:

  • Payments will be charged automatically

  • Access may be revoked for failed or canceled payments

  • Fees are non-refundable

Use of Wholesale Pricing

All pricing provided within the portal is wholesale pricing intended for resale.

Brokers may:

  • Set their own resale pricing

  • Sell directly to end customers

Brokers may not:

  • Misrepresent Apex Diamond Company products

  • Use deceptive or misleading marketing practices

Orders & Fulfillment

All jewelry is made to order.

Orders placed through the portal:

  • Are submitted for production upon confirmation

  • Cannot be modified or canceled once production begins

Apex Diamond Company may:

  • Ship directly to your customer (concierge fulfillment), if requested

  • Ship to you

No Returns or Exchanges

All orders are final.

Due to the made-to-order nature of our products, no returns or exchanges are accepted.

If an item arrives damaged or defective, Apex Diamond Company will review and determine an appropriate resolution.

Product Representation

Brokers are responsible for:

  • Communicating accurate product details to customers

  • Setting appropriate expectations regarding timelines and specifications

All diamond specifications are approximate and may vary slightly.

Intellectual Property

All content, including product images, videos, and materials, remains the property of Apex Diamond Company.

These materials may be used for marketing purposes by active brokers but may not be resold, redistributed, or altered without permission.

Limitation of Liability

Apex Diamond Company is not responsible for:

  • Broker pricing decisions

  • Customer disputes handled by the broker

  • Indirect or consequential damages

Liability is limited to the amount paid for the product in question.

Termination

Apex Diamond Co. reserves the right to:

  • Suspend or terminate broker access at any time

  • Revoke access for misuse, non-payment, or policy violations

Changes to Terms

We reserve the right to update or modify these Terms & Conditions at any time without prior notice. Continued use of the platform constitutes acceptance of those changes.
